These Terms of Service ("Terms") apply to The Movement & Muscle Method mobile application (the "Application" or "App") for iOS and Android devices, created by The Movement & Muscle Method LLC (the "Service Provider," "we," "us," or "our") as a Freemium service.

⚠️ IMPORTANT: By downloading, installing, or using the Application, you agree to be bound by these Terms. Please read them carefully before using the App. If you do not agree to these Terms, do not use the Application.

1. Acceptance of Terms

By accessing or using The Movement & Muscle Method application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and The Movement & Muscle Method LLC.

2. Eligibility and Age Requirement

You must be at least 18 years of age to use this Application. By using the App, you represent and warrant that you are 18 years or older and have the legal capacity to enter into these Terms.

The Application is not intended for minors under 18 years of age. We do not knowingly provide services to individuals under 18.

3. Description of Service

The Movement & Muscle Method provides a comprehensive 23-week periodized powerlifting training program designed for intermediate to advanced lifters. The Application includes:

• Structured training program progressing through 5 phases (Hypertrophy, Strength, Peaking, Testing, Deload)

• Workout tracking with sets, reps, weights, and RIR (Reps in Reserve) autoregulation

• Exercise selection system with main lifts and accessory movements

• Personal record tracking and progress visualization

• Cloud data backup and synchronization across devices

• Data export functionality

4. Subscription Terms and Payments

4.1 Subscription Plans

The Application operates on a Freemium subscription model. Access to the full training program requires an active paid subscription.

Current Subscription Options:

• Monthly Subscription: $16.99/month, billed monthly

• Free Trial: New subscribers receive a 7-day free trial

Note: Subscription pricing is subject to change. We will notify users of any price changes in advance.

4.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged through your Apple App Store or Google Play Store account at confirmation of purchase and upon each renewal.

4.3 Free Trial Terms

If a free trial is offered:

• You will not be charged during the trial period

• You must cancel before the trial period ends to avoid being charged

• If you do not cancel, you will be automatically charged for the subscription at the end of the trial

• Free trials are limited to one per user

4.4 How to Cancel Your Subscription

You may cancel your subscription at any time through your device's subscription management settings:

• iOS: Settings > [Your Name] > Subscriptions > The Movement & Muscle Method > Cancel Subscription

• Android: Google Play Store > Menu > Subscriptions > The Movement & Muscle Method > Cancel Subscription

Important: Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date.

4.5 Refund Policy

All subscription payments are processed through Apple or Google and are subject to their respective refund policies. We do not have the ability to issue refunds directly.

• No refunds for partial billing periods or unused portions of a subscription

• No refunds if you forget to cancel before renewal

4.6 Payment Processing

All payments are processed by Apple (for iOS) or Google (for Android). We do not collect, store, or have access to your payment information. Your payment details are handled according to Apple's and Google's privacy policies.

5. Account Responsibilities

5.1 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials

• All activities that occur under your account

• Notifying us immediately of any unauthorized use of your account

• Ensuring your device remains secure and password-protected

5.2 Device Security

We strongly advise against jailbreaking (iOS) or rooting (Android) your device, as this:

• Compromises your device's security

• May expose your data to malware and viruses

• Could cause the Application to malfunction or not work at all

• Voids any support obligations we may have

5.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service

• Engage in fraudulent activity or payment disputes

• Use the Application for unlawful purposes

• Attempt to reverse engineer, hack, or compromise the Application

6. Intellectual Property Rights

6.1 Our Rights

All intellectual property rights in the Application, including but not limited to:

• The training program methodology and structure

• Software code and algorithms

• Design, graphics, and user interface

• Trademarks, logos, and branding

• Content, text, and instructions

6.2 Restrictions

You may not:

• Copy, modify, or create derivative works of the Application

• Reverse engineer, decompile, or extract source code

• Use the Application's content to create competing products

• Share your account credentials with others

6.3 Your Content

You retain ownership of your workout data, personal records, and other content you create in the Application. By using the App, you grant us a limited license to store and process this data solely to provide the service to you.

The Movement & Muscle Method Application provides a strength training program for educational and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

7.2 Consult a Healthcare Provider

You should consult with a physician or other qualified healthcare provider before:

• Beginning any exercise program, especially if you have been sedentary

• Making any changes to your training routine

• Starting the program if you have any pre-existing medical conditions, injuries, or health concerns

7.3 Assumption of Risk

By using this Application and following the training program, you acknowledge and agree that:

• Exercise involves inherent risks including, but not limited to, muscle strains, sprains, fractures, cardiovascular stress, and in extreme cases, disability or death

• You voluntarily assume all risks associated with using the Application and following the training program

• You are physically capable of performing the exercises and have consulted a healthcare provider if necessary

• You will exercise proper form and technique and know when to stop if you experience pain or discomfort

• You will use appropriate safety equipment (e.g., spotters, safety bars, proper footwear)

7.4 Individual Results Vary

The training program's effectiveness depends on many factors including your current fitness level, genetics, nutrition, recovery, consistency, and effort. We make no guarantees or warranties about specific results, strength gains, or performance improvements.

7.5 Listen to Your Body

Stop exercising immediately and seek medical attention if you experience:

• Chest pain or pressure

• Severe joint or muscle pain

• Dizziness, lightheadedness, or nausea

• Shortness of breath beyond normal exertion

• Any unusual symptoms or discomfort

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose

• Warranties that the Application will be uninterrupted or error-free

• Warranties regarding the accuracy or reliability of content

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MOVEMENT & MUSCLE METHOD LLC SHALL NOT BE LIABLE FOR:

• Any injuries, health issues, or medical conditions arising from use of the Application or training program

• Direct, indirect, incidental, consequential, or punitive damages

• Loss of profits, data, or use of the Application

• Damages resulting from reliance on information provided by the Application

• Damages resulting from third-party services (Firebase, RevenueCat, Apple, Google)

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

8.3 Indemnification

You agree to indemnify and hold harmless The Movement & Muscle Method LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Application

• Your violation of these Terms

• Any injuries or damages resulting from your participation in the training program

• Your violation of any third-party rights

9. Internet Connection and Data Charges

The Application requires an internet connection (Wi-Fi or mobile data) for certain features including:

• User authentication and account access

• Cloud data synchronization

• Subscription verification

• App updates

You are responsible for:

• Obtaining internet access

• All data charges from your mobile provider

• Roaming charges if using the app outside your home territory

• Ensuring you have permission to incur charges if you're not the bill payer

We cannot be held responsible if the Application does not function properly due to lack of internet connectivity or if you've exhausted your data allowance.

10. Third-Party Services

The Application utilizes third-party services, each with their own Terms and Conditions:

• Google Play Services

• Google Analytics for Firebase

• Firebase Crashlytics

• Expo

• RevenueCat

We are not responsible for the availability, content, or practices of these third-party services. Your use of these services is subject to their respective terms.

11. App Updates and Availability

11.1 Updates

We may update the Application periodically to:

• Fix bugs and improve performance

• Add new features

• Ensure compatibility with new operating system versions

• Enhance security

You agree to accept updates when offered. Some updates may be required to continue using the Application.

11.2 Service Availability

While we strive for 99.9% uptime, we do not guarantee that the Application will always be available or function without interruption. The Application may be temporarily unavailable due to:

• Scheduled maintenance

• Technical issues or server problems

• Third-party service outages (Firebase, Apple, Google)

• Internet connectivity issues

11.3 Service Termination

We reserve the right to discontinue the Application at any time without prior notice. Upon termination:

• Your license to use the Application will end

• You must cease using and delete the Application

• You should export your data before termination (if possible)

• No refunds will be provided for unused subscription time

12. User Conduct

You agree not to:

• Use the Application for any unlawful purpose

• Attempt to gain unauthorized access to the Application or other users' accounts

• Interfere with or disrupt the Application's functionality

• Upload viruses, malware, or malicious code

• Harass, abuse, or harm other users

• Use the Application to distribute spam or unauthorized advertising

• Impersonate another person or entity

• Collect or harvest other users' information

13. Data Backup

While we provide cloud backup through Firebase, you are ultimately responsible for maintaining backup copies of your important data. We recommend regularly using the built-in data export feature to save your workout history.

We are not liable for any loss of data resulting from:

• Technical failures or server issues

• Account deletion or termination

• User error

• Device loss, damage, or malfunction

14. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

By using the Application, you consent to our collection and use of your data as described in the Privacy Policy.

15. Geographic Restrictions

The Application is available worldwide, but subscription availability and pricing may vary by region based on Apple App Store and Google Play Store policies.

16. Dispute Resolution and Governing Law

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

16.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Application, you agree to first contact us at support@movementmusclemethod.com to attempt to resolve the dispute informally.

16.3 Arbitration

If we cannot resolve a dispute informally, any remaining disputes shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Movement & Muscle Method LLC regarding the Application and supersede any prior agreements.

19. Changes to These Terms

We may update these Terms of Service from time to time. When we do:

• We will update the "Effective Date" at the top

• We will notify you through the Application or via email

• Your continued use after changes constitutes acceptance of the new Terms

• Material changes may require your explicit consent
